Terms of Service

By accessing or using joseaburto ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

joseaburto is operated by joseaburto ("Company", "we", "us"). These Terms constitute a legally binding agreement between you and the Company.

joseaburto is a multi-tenant SaaS platform that allows businesses ("Tenants") to:

• Connect a WhatsApp Business account via Meta's Embedded Signup
• Receive and process inbound WhatsApp messages automatically
• Send automated or manual replies to WhatsApp contacts
• View message history and account status via a web dashboard

The Service relies on the Meta WhatsApp Cloud API. Use of the Service is therefore also subject to Meta's Platform Terms and WhatsApp Business Policy.

To use joseaburto you must:

• Be at least 18 years of age
• Have the legal authority to enter into a binding agreement on behalf of yourself or your organization
• Have a valid WhatsApp Business account in good standing with Meta
• Comply with Meta's Platform Terms, WhatsApp Business Policy, and all applicable laws

You register for joseaburto using your Facebook account, authenticated via Clerk. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately at support@joseaburto.com if you suspect unauthorized access

You may not share your account with others or create accounts on behalf of third parties without their consent.

You agree to use joseaburto only for lawful purposes and in accordance with these Terms. You must not:

• Send spam, unsolicited bulk messages, or messages to users who have not opted in
• Violate WhatsApp's Messaging Policy or Meta's Platform Terms
• Transmit content that is illegal, harmful, threatening, defamatory, obscene, or infringes intellectual property rights
• Use the Service to conduct phishing, fraud, or other deceptive practices
• Attempt to reverse-engineer, decompile, or exploit the Service
• Use automated scripts or bots to abuse the API rate limits
• Resell or sublicense access to the Service without written permission

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy without notice.

joseaburto is built on the WhatsApp Cloud API. As a user, you are independently responsible for:

• Obtaining proper consent from your end-users before messaging them
• Complying with WhatsApp's opt-in requirements
• Adhering to Meta's messaging frequency guidelines and template requirements
• Maintaining your WhatsApp Business account in good standing

joseaburto is not responsible for the suspension or termination of your WhatsApp Business account by Meta due to policy violations.

The joseaburto platform, including its design, code, trademarks, and content, is the exclusive property of joseaburto and is protected by applicable intellectual property laws.

You retain ownership of the content you send and receive through the Service. You grant joseaburto a limited license to process and store that content solely to provide the Service.

joseaburto offers a free tier and paid subscription plans. Paid plans are billed on a monthly or annual basis as described on our pricing page.

• All fees are non-refundable except where required by law
• We may change pricing with 30 days' notice to existing subscribers
• Failure to pay may result in downgrade to the free tier or suspension

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. Availability of the Service depends on third-party infrastructure including Meta's WhatsApp Cloud API, which is outside our control.

To the maximum extent permitted by applicable law, joseaburto and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of or inability to use the Service.

Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

You agree to indemnify, defend, and hold harmless joseaburto and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including Meta's Platform Terms.

You may terminate your account at any time by deleting it from the dashboard. We may terminate or suspend your access immediately if:

• You breach these Terms
• We are required to do so by law or Meta
• We discontinue the Service (with 30 days notice where possible)

Upon termination, your right to use the Service ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.

We may modify these Terms at any time. When we make material changes, we will notify you via email or a prominent notice in the platform at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
